Terms and Conditions 

  1. Conditions of Business of HR China International, which is acting as an employment agency for the introduction and supply of permanent staff.
  1. In the absence of any express or implied prior acceptance of these Terms and Conditions of Business by the Employer, the employer is deemed to agree and accept these Terms of Conditions of Business by virtue of an Interview or the agreement to employ an applicant. Interviewing of an HR China International candidate will constitute an acceptance of these terms and conditions.
  1. The fee payable by an Employer is for the introduction of an applicant. The word ‘introduction’ means the presentation in written or oral form of an applicant by HR China International to the Employer for engagement, whether or not the Employer knew of such applicants previously. The Employer engages to settle the fee payable immediately in whatever capacity the Employer engages the applicant. A Contract will exist between HR China International and the Employer if any appointment of a Candidate is made within 12 months next following the introduction of any subsequent introduction

  1. Fees are calculated on annual salaries, and their equivalent in Ren Min Bi or other currencies, as follows:

      US$ 9,999 and under ………. …...12%

      US$10,000 – US$19,999……….. 15%

      US$20,000 – US$24,999………...17%

      US$25,000 and over .……….……20% 

  1. There is no fee chargeable for provision of anonymous CV data
  1. Rates may be varied by HR China International according to the volume and quality of business. Employers may be costed on an individual basis.
  1. Introductions are confidential and restricted to the individual employer.  If the Employer or their representative or employee refers the applicant to any other person, firm or corporation within 12 months of the initial introduction, the introduction fee, as above, will become payable by the original Employer.
  1. The company can accept no liability for damage to property or for any other loss including loss of profits or for any injury to persons arising directly or  indirectly from any act or omission of any applicant introduced by HR China International even if such act or omission is negligent, fraudulent or dishonest.
  1. These Terms and Conditions may only be varied by a Director of HR China International in writing.
  1. Payment for introductions is payable by the employer on receipt of invoice. Where an invoice from HR China for a candidate is settled in GBP£ against a foreign salary denomiated in another currency (e.g. US$ or CNY RMB), the exchange rate applicable shall be that of the first day the candidate takes up his/her post.
  1. The unsuitability of any candidate should be notified in writing immediately to HR China International.
  1. In the event of a candidate being made redundant for mutually agreed reasons of unsuitability, HR China International will, in the first eight week period, refund 12.5% per full week remaining, up to a maximum of 87.5%.  A management fee of £250 will be retained.
  1. The interpretation and performance of these conditions will be governed by the law of England.
